§ 30333 General Manager Removal Process

Key Takeaways

  • •The boss (general manager) can stay in the job as long as the board wants.
  • •The board can fire the boss, but they have to vote on it, and most of them must agree.
  • •If the boss asks, the board must tell him in writing why they want to fire him and let him explain his side at a meeting before they vote.
  • •The board can’t cut the boss’s pay unless they vote on it the same way and let him explain his side first.

Example

Imagine the boss of a big company is doing a bad job, and the board wants to fire him.

The board has to vote, and most of them must agree to fire him. If the boss asks, they have to write down why they want to fire him and let him talk at a meeting before they make the final decision. They can’t just cut his pay without doing the same thing.

§ 30333 General Manager Removal Process

The general manager shall hold office for an indefinite term and may be removed by the board upon the adoption of a resolution by the affirmative vote of a majority of all members of the board. Before the general manager may be removed, he shall, if he demands it, be given a written statement of the reasons alleged for his removal and he shall have the right to be publicly heard thereon at a meeting of the board prior to the final vote on the resolution providing for his removal, but pending and during such hearing the board may suspend him from office. The board may not reduce the salary of the general manager below the amount fixed at the time of his original appointment except upon the adoption of a resolution by a like vote and after a like opportunity to be heard. The action of the board in suspending or removing the general manager or reducing his salary is final. (Added by Stats. 1964, 1st Ex. Sess., Ch. 62.)
