§ 22814 Bond Cancellation Hearing Process

Key Takeaways

  • •The board listens to people's opinions about canceling unsold bonds.
  • •If the board thinks it's best for the area, they can cancel the unsold bonds.
  • •Once canceled, the bonds and the vote that approved them are no longer valid.

Example

A small town voted to sell bonds to build a new park, but not all bonds were sold. Some people now think the park isn't needed.

The town board listens to everyone's opinions. If they decide the park isn't needed anymore, they can cancel the unsold bonds, and the original vote to sell them doesn't count.

At the time and place designated in the notice, or at any subsequent time to which the hearing is postponed, the board of supervisors shall hear any reason that may be submitted for or against the granting of the petition. If the board of supervisors deems it for the best interest of the district named in the petition that the unsold bonds be canceled, it shall make and enter an order in its minutes that the unsold bonds are canceled. Thereafter the bonds and the vote by which they were authorized to be issued have no validity whatever. (Added by Stats. 1953, Ch. 151.)
