§ 13511 Special District Creation Election

Key Takeaways

  • •The board can decide to create a special district for handling trash or sewage.
  • •They must hold an election to ask people if they want this district.
  • •The election can also ask if the district can borrow money (bonds) to build stuff like treatment plants.
  • •If they don’t need to borrow money now, they can just ask about creating the district and vote on borrowing later.

Example

A town wants to build a new trash recycling center but needs money to do it.

The town leaders call a vote to ask people if they want the recycling center and if they agree to borrow money to build it. If people say yes, the town can move forward.

§ 13511 Special District Creation Election

At any time after the board has approved the creation of the proposed special district, and fixed its boundaries, the board shall call and publish notice of an election within the proposed special district for the purpose of determining whether the proposed special district will be created and, if the board so determines, for the submission of a proposition for incurring a bonded indebtedness for the acquisition, construction, or completion by the district of any works, lands, structures, rights, or any other property necessary or convenient for the recovery of resources from solid waste or for the collection, treatment, or disposition of sewage matter for the special district. If the board determines that no bonded indebtedness is presently necessary, the board may call the election for the creation and establishment of the special district only, and a bond election may later be called. (Amended by Stats. 1977, Ch. 128.)
