§ 125541 Pension Plan Acquisition Rights

Key Takeaways

  • •If the district buys a utility company (like water or electricity), the workers' pension plans stay the same.
  • •The district must pay for any pension costs when buying the company.
  • •The deal to buy the company must clearly list who gets pensions and what they get.

Example

A city buys a private water company that has workers with pensions.

The city must keep giving those workers their pensions just like before. The city also has to pay for those pension costs when buying the company. The purchase agreement must say exactly who gets pensions and how much.
