§ 12363 Retirement Board Eligibility Authority

Key Takeaways

  • •The retirement board decides who can join the retirement system and get benefits.
  • •The board makes the rules for who can keep getting benefits and can change benefits for service or disability.
  • •The board's decision is final and can't be changed unless they lied or were really unfair.

Example

If a firefighter gets hurt on the job and can't work anymore, they ask the retirement board for disability benefits.

The board checks if the firefighter qualifies and decides how much money they get. If the board says no, the firefighter can't get the money unless they can prove the board was dishonest or really unfair.
