§ 103602 Bondholder Contract Enforcement

This law says that any bonds or similar debt the district issues are a contract that the district (or its successors) must keep paying, even if the district is dissolved or parts of it leave.

Key Takeaways

  • •Bonds are a contract that the district can’t back out of.
  • •If the district ends or parts of it leave, the debt still follows the property.
  • •Revenue from the projects that were funded by the bonds stays pledged until the bonds are paid off.

Example

A county district issues revenue bonds to build a new wastewater treatment plant. Years later the district is dissolved and the land becomes part of a neighboring city.

Even though the original district no longer exists, the new city must still pay the bond holders because the law says the debt sticks with the property and the successors.
