§ 103201 District Legal Capacity

This law says a district (like a school district) can go to court to sue someone or be sued, unless another law says otherwise.

Key Takeaways

  • •The district can start a lawsuit or be sued.
  • •It can do this in any court that has the right to hear the case.
  • •If another law says something different, that other law wins.

Example

A family thinks the district didn't fix a dangerous playground and wants to sue for injuries.

Because of this law, the family can file a lawsuit against the district in the proper court, and the district can also file a lawsuit if it needs to collect money from someone.
