§ 10106 Sewer Discharge Near Municipalities

This law says you can't build a sewage pipe in another town if the waste ends up dumped into the Pacific Ocean within one mile of that town's border or in any way that could be a public nuisance.

Key Takeaways

  • •No sewer can be built in another municipality if it dumps sewage into the ocean within one mile of that municipality’s border.
  • •Any sewage disposal that could create a public nuisance is also prohibited.
  • •Municipalities must find other ways to handle sewage that don’t affect neighboring towns.

Example

Town A wants to run a new sewer line that sends its waste into the ocean just 0.5 miles off the coast of neighboring Town B.

Because the waste would be discharged into the ocean so close to Town B, the law says Town A cannot build that sewer line.
