§ 100400 Vta Bond Approval Process

The law lets the VTA borrow money by selling bonds, but only if the total bonds are no more than 15% of the assessed value of taxable property in Santa Clara County and only after a two‑thirds board vote and a voter referendum.

Key Takeaways

  • •The board must approve the bond plan with a two‑thirds vote.
  • •A public election is required before any bonds can be sold.
  • •Total bonds cannot exceed 15% of the county's assessed taxable property value.
  • •Bond interest cannot be higher than 7% per year.
  • •Bonds can mature for up to 50 years.
  • •The ordinance must detail the purpose, cost estimate, bond amount, term, interest rate, election date, and voting procedure.

Example

The VTA wants to build a new light‑rail extension and needs to issue bonds to pay for it.

The board must pass an ordinance that lists the project, estimates costs, sets the bond amount, and calls a local election. The ordinance must also state that the bond amount cannot be larger than 15% of the county's assessed property value.

How to Calculate

Maximum bond amount = 0.15 × Assessed value of taxable property

  1. Look up the most recent equalized assessment roll for Santa Clara County to find the total assessed value of taxable property.
  2. Multiply that assessed value by 0.15 (15 percent).
  3. The product is the highest total amount of bonds the VTA may issue under this rule.

Assume the latest assessment shows $2 billion in taxable property value.

Result: 300000000
