§ 100162 Vta Transit Facility Leases

This law lets the VTA rent out its transit buildings or parts of them to anyone, and it can also allow the renter to rent part of it to someone else, as long as the VTA thinks it helps the public.

Key Takeaways

  • •The VTA can rent or contract for any part of its transit facilities.
  • •It can let the renter sub‑lease part of the space to another party.
  • •The VTA decides the terms as long as they are in the public interest.
  • •“Operator” includes any public agency or any person.

Example

A private bus company wants to use a VTA bus garage to store its buses and run routes. The VTA can sign a lease with that company, and the company could then let another small shuttle service use a corner of the garage.

Because the law says the VTA can lease its facilities to any operator and allow subleases, the VTA can make that agreement and set any rules it wants to protect the public.
