§ 232 Petition Filing Jurisdiction

This law says you must file your request in the same estate case where you were appointed or where you say you have a claim, and the first court that takes the case keeps control of it.

Key Takeaways

  • •File your petition in the estate case where you were appointed or claim an interest.
  • •The first court that gets jurisdiction under this rule keeps exclusive control of the case.
  • •No other court can take over the case once the first one has jurisdiction.

Example

Jane is named the executor of her aunt's estate and wants to ask the court for permission to sell a house. She must file her petition in the probate case that named her executor, not in any other court case.

Because Jane got her appointment in that probate case, the law says she has to file her request there, and the court that first handles it will stay in charge of the whole matter.
