§ 340 Military Service Injury Compensation

This law says that if a California National Guard member gets hurt or dies while working for the state, they or their family get money to help. The amount is based on how much money they made the year before they got hurt.

Key Takeaways

  • •This only applies if the person was hurt or killed while working for the state, not the federal government.
  • •The money they get is based on what they earned the year before they got hurt.
  • •There is a maximum limit to how much they can get, set by the state.

Example

A National Guard member gets injured during a state emergency like a wildfire.

If they were earning $50,000 a year before getting hurt, their family or they will get money to help based on that $50,000.

How to Calculate

Compensation = Average income from all sources in the past year (up to the maximum allowed by state law)

  1. Find out how much money the person made from all jobs in the last year before they got hurt.
  2. Make sure the amount does not go over the highest amount allowed by the state for these cases.
  3. Use that number to decide how much money they or their family will get.

A National Guard member made $60,000 last year from their job and side work.

Result: They will get compensation based on $60,000 because it is under the $70,000 limit.
