§ 120 State Militia Composition

This law says the state's militia is made up of the National Guard, State Guard, Naval Militia, and also people who aren't organized into a unit.

Key Takeaways

  • •The militia includes three organized groups: National Guard, State Guard, and Naval Militia.
  • •These three groups are called the "active militia".
  • •Anyone not in those groups is still part of the "unorganized militia".

Example

A big flood hits the state and the governor asks the National Guard and State Guard to help rescue people and protect property.

Because the law says the National Guard and State Guard are part of the state's militia, they can be called in to do things like rescue, clean‑up, and keep order during emergencies.
