§ 738 Commissioner'S Examination Authority

This law lets the commissioner look at the State Compensation Insurance Fund just like any other insurance company, unless a specific rule says the fund is off‑limits.

Key Takeaways

  • •The commissioner can examine the State Compensation Insurance Fund.
  • •The power is the same as for any other insurer.
  • •If a specific exemption exists, the commissioner cannot examine the fund.

Example

The commissioner wants to check the fund’s records to see if it’s paying workers’ compensation claims correctly.

Because the law says the commissioner has the same power to examine the fund as other insurers, they can review the fund’s books unless another law specifically says the fund can’t be examined.
