§ 8653 Family Plot Interment Waiver

Key Takeaways

  • •If you have the right to be buried in a family plot, you can give up that right for someone else in the family.
  • •The person you give it to can then be buried there instead of you.
  • •This only works for family members or their spouses.

Example

Your grandma has a family burial plot where she, her kids, and their spouses can be buried. But your uncle (her son) doesn’t want to be buried there—he’d rather give his spot to his wife, your aunt.

Your uncle can sign a paper saying he gives up his right to be buried in the plot. Then, your aunt can be buried there instead, even if she wasn’t originally part of the family plan.
