§ 8603 Cemetery Plot Inheritance Rules

Key Takeaways

  • •If you own a burial plot but no one is buried there, or all bodies are moved out, and you die without saying who gets the plot, it goes to your family.
  • •You can decide who gets the plot by writing it in your will or giving a paper to the cemetery before you die.
  • •Your spouse can still be buried there even if you didn’t leave the plot to them.

Example

A man owns a burial plot but never uses it. He dies without a will and doesn’t tell anyone who should get the plot.

The plot will go to his closest family, like his kids or siblings. But if he was married, his wife can still be buried there even if the plot doesn’t go to her.
