§ 80210 Brownfield Property Definition

Key Takeaways

  • •A 'Brownfield' is an empty property in a city that used to have a business but has been empty for at least 1 year.
  • •It cannot be a place that the government says is very dirty and needs special cleaning (like on the National Priorities List).
  • •It cannot be owned by the U.S. government.
  • •If a business next door wants to grow into this empty spot, it usually doesn’t count as a Brownfield unless there’s a special rule.

Example

An old factory in the middle of a town has been empty for 2 years. No one has used it since the factory closed.

This empty factory could be called a Brownfield because it’s in a city, was once used for business, and has been empty for more than a year. If someone wants a loan to clean it up or reuse it, this law helps decide if it qualifies.
