§ 79895 Liability Release Conditions

Key Takeaways

  • •If someone is let off the hook for cleaning up a mess, they can still be in trouble if they make the mess worse later.
  • •The release from responsibility only applies to the cleanup they were supposed to do, not to any new problems they cause.
  • •This rule starts on January 1, 2024.

Example

A factory is told to clean up pollution in a river. They do some cleanup but then dump more waste later.

Even if the factory was initially forgiven for the first pollution, they can still get in trouble for dumping more waste and making the river dirtier.
