§ 7933 Cemetery Transfer Court Order

Key Takeaways

  • •A cemetery can ask a court to let them transfer ownership of land or plots.
  • •The court will tell the cemetery how to let people know about the request (like posting a notice).
  • •Anyone who owns a plot or used to own one can say if they agree or disagree with the transfer.
  • •The court will only allow the transfer if it’s good for the cemetery and everyone was properly told about it.

Example

A small town cemetery wants to sell some of its land to a park because they don’t have enough money to take care of it.

The cemetery has to ask a court for permission first. They’ll have to post a notice in the newspaper so people know. If someone who owns a plot there doesn’t want the sale to happen, they can tell the court. The court will listen to everyone and only say yes if it’s the best thing for the cemetery.
