§ 6830 District Territory Annexation Rules

Key Takeaways

  • •Land can be added to a district if it's in the same county or in the natural watershed area of the district.
  • •The land can be next to the district, touch any part of the district, or be separated by things like roads, rivers, or train tracks.
  • •Even if the land isn't touching the district, it can still be added if the district board thinks it will benefit from being included.
  • •The land being added can be one or more separate pieces; they don't have to be connected to each other.

Example

A small town wants to add a nearby farm to its water district.

The farm is next to the town and uses the same river for water. The town can add the farm to its water district because it's in the same watershed area and touches the town's border.

§ 6830 District Territory Annexation Rules

There may be annexed to a district any of the following territory which is in the same county as the district or which is within another county but in the natural watershed area of the district: (a)  Any territory contiguous to the district. (b)  Any territory any point of which touches any point of the district. (c)  Any territory separated from the district by a “separating barrier,” which term includes a street, road, highway, railway line, railway crossing, railway right-of-way, watercourse, lagoon, or other natural barrier. (d)  Any territory not contiguous to the district that will, in the opinion of the district board, be benefited by inclusion in the district. Any territory specified in this section may consist of one or more separate parcels of land, but it is not necessary that all parcels shall constitute in the aggregate one tract of land. (Amended by Stats. 1965, Ch. 2043.)
