§ 43600 Used Vehicle Emission Standards

Key Takeaways

  • •The state sets rules to limit pollution from old cars.
  • •These rules must be possible with current technology.
  • •The state can't force people to add special parts to old cars unless a law says so.
  • •The rules can apply to just the car's engine, not the whole car.

Example

You own a 10-year-old car that releases a lot of smoke.

The state might say your car has to meet certain pollution rules, but they can't make you add a special part to your car unless there's a specific law that says you have to.

§ 43600 Used Vehicle Emission Standards

The state board shall adopt and implement emission standards for used motor vehicles for the control of emissions therefrom, which standards the state board has found to be necessary and technologically feasible to carry out the purposes of this division; however, the installation of certified devices on used motor vehicles shall not be mandated except by statute. Such standards may be applicable to motor vehicle engines, rather than to motor vehicles. (Added by Stats. 1975, Ch. 957.)
