§ 40462 Air Quality Compliance Deadlines

Key Takeaways

  • •The law says California must make a plan to clean up dirty air as fast as possible using the best tools and fuels we have.
  • •The plan must have clear deadlines to meet both state and federal clean-air rules.
  • •New buildings and growth in smoggy areas must follow the clean-air plan so the air stays clean.
  • •The plan must list what money and energy it needs to work.

Example

A big new shopping mall is being built in Los Angeles.

The mall builders have to follow the clean-air plan—maybe use electric trucks, plant trees, and put in bike lanes so cars don’t make more smog.

§ 40462 Air Quality Compliance Deadlines

(a)  The plan and subsequent revisions shall contain deadlines for compliance with the federally mandated attainment of primary ambient air quality standards. The plan and subsequent revisions shall contain deadlines and schedules to achieve the state ambient air quality standards by the earliest date achievable by the application of all reasonably available control measures and technologies, including, but not limited to, the best available control technology, indirect source controls, and transportation control measures, and the use of cleaner burning alternative fuels. The plan and subsequent revisions shall contain deadlines and schedules to achieve the federal secondary ambient air quality standards by the earliest date achievable by the application of all reasonably available control measures and technologies. (b)  The plan and subsequent revisions shall ensure that future growth and development in the South Coast Air Basin and within the sensitive zone established pursuant to subdivision (a) of Section 40410.5 are, to the maximum extent feasible, consistent with the goal of achieving and maintaining those air quality standards. The revisions to the plan shall identify the resources necessary to carry out its provisions, including enforcement costs and the effect of its provisions on energy resources. (Amended by Stats. 1987, Ch. 1301, Sec. 14.)
