§ 38079 Nonprofit Agreement Payment Rules

Key Takeaways

  • •If the government is late paying a nonprofit group for work, they have to follow the rules about late payments.
  • •The health department has to follow the same rules for all deals with nonprofits, not just clinics.
  • •The department can't use certain health fund money unless the government officially gives them permission.

Example

A small nonprofit helps the government with a health program, but the government pays them 3 months late.

The government has to follow the late payment rules and might have to pay extra for being late. They also can't just take money from the health fund to pay the nonprofit—they need special permission first.

§ 38079 Nonprofit Agreement Payment Rules

(a)  All cooperative agreements, regardless of the size of the contracting nonprofit organization, are subject to the late payment provisions in Section 927.6 of the Government Code. (b)  In implementing this division, the department shall have the authority of, and be subject to, the provisions set forth in Chapter 2 (commencing with Section 124475) of Part 4 of Division 106, except that those provisions apply to all cooperative agreements, not only those agreements with clinics. However, notwithstanding Section 124500, moneys in the Clinic Revolving Fund of the State Department of Health Services shall be used for purposes of this division only upon appropriation of funds by the Legislature for that purpose. (Amended by Stats. 2000, Ch. 776, Sec. 3. Effective September 27, 2000.)
