§ 34244 Authority Contract Validity Proof

Key Takeaways

  • •If a government group (like a city or county) says they need a special team (called an 'authority') to do something, they just need to write it down in a formal paper called a 'resolution'.
  • •This paper must say that either the area is growing fast or that the roads are too crowded, and they need help to fix it.
  • •Once this paper is written and signed, no one can say the team wasn’t allowed to do its job or make deals.
  • •A copy of this paper, signed by the right person, can be used in court if someone questions the team’s work.

Example

A city wants to build a new bridge because the roads are always jammed with cars.

The city writes a paper saying, 'We need a special team to build this bridge because our roads are too crowded.' Once they do this, the team can start working, and no one can later say the team wasn’t allowed to build the bridge.

§ 34244 Authority Contract Validity Proof

In any proceeding involving the validity or enforcement of or relating to any contract of the authority, the authority is conclusively deemed to have been established and authorized to transact business and exercise its powers upon proof of the adoption of a resolution by the governing body declaring the need for the authority. The resolution is sufficient if it declares that there is such need for an authority and finds in substantially the terms of Section 34242 that either or both of the conditions set forth in that section exist in the county or city. A copy of the resolution duly certified by the clerk is admissible in evidence in any proceeding. (Added by Stats. 1951, Ch. 710.)
