§ 26142 Commercial Tenant Mold Reporting

Key Takeaways

  • •If you rent a store or factory and see mold or lots of water leaks, you must tell the landlord in writing.
  • •You have to let the landlord check the problem and fix it if they are supposed to take care of the building.
  • •This rule doesn’t start until the government sets official mold rules, at least six months after they decide what those rules are.
  • •This law is only for stores and factories, not for houses or apartments where people live.

Example

You rent a small shop for your bakery and notice black mold growing on the walls near the sink.

You have to write a note or email to your landlord telling them about the mold. Then, you must let them come in to look at it and fix it if they are responsible for repairs.

The tenant shall make the property available to the landlord or his or her agents for appropriate assessment or remedial action as soon as is reasonably practicable if the landlord is responsible for maintenance of the property. Nothing in this section is intended to any way affect existing duties and obligations of residential tenants and landlords.
