§ 19810 Flammable Fabric Safety Standards

Key Takeaways

  • •This law is about clothes, fabrics, and other materials made from natural or synthetic fibers.
  • •Some of these materials can catch fire very easily and are dangerous.
  • •The Fire Marshal decides which materials are too dangerous because they can catch fire easily.
  • •The law gives the Fire Marshal the job to test these materials and stop the use of the most dangerous ones.

Example

A company makes a Halloween costume for kids using a very fluffy and sparkly fabric.

If the Fire Marshal tests this fabric and finds out it catches fire super fast, they can say it's too dangerous. The company then can't sell those costumes because they could hurt kids if they get too close to a candle or flame.

§ 19810 Flammable Fabric Safety Standards

(a)  “Article” as used in this chapter means and includes any article of wearing apparel, cloth, drapery or other fabric or material made from or containing any natural or synthetic fiber. (b)  “Vendor” as used in this chapter means any individual, firm or corporation engaged in the manufacture for sale or the sale of articles as herein defined. (c)  “Inflammable article” as used in this chapter is any article made from or containing natural or synthetic fiber and determined by the Fire Marshal to be so highly inflammable as to constitute a dangerous risk of fire and hazard of injury to persons and property, taking into consideration the use or uses for which the article is made and designed to serve. (d)  It has recently come to notice that of the various natural or synthetic fibers adapted and adaptable for use in the making of articles, as herein defined, some are so inflammable as to constitute a dangerous risk of fire and hazard of injury to persons and property. Provision should be made for the avoidance of such risks and hazards by preventing the use of such highly inflammable fibers. It is not feasible by statute to prescribe more specific tests than those herein prescribed, for it would appear that none such have yet been fully developed. It is necessary, therefore, to commit to the State Fire Marshal the conduct of research in these matters, the development of tests for these materials, and the administration of the provisions of this chapter for the prevention of the risks and the avoidance of the hazards described. (Amended by Stats. 1947, Ch. 793.)
