§ 17991 Property Transfer Violation Liability

Key Takeaways

  • •If a house or building has problems (like being unsafe) and the owner gets a warning from the government, selling the property doesn’t stop the government from fixing the problem.
  • •If the property is sold while the problem is still being fixed, the seller must tell the government who bought it within 5 days.
  • •The seller must also give the government personal details (like names and IDs) of the buyer and anyone who owns more than 5% of the property.

Example

A landlord gets a warning from the city because his apartment building is unsafe. Instead of fixing it, he sells the building to someone else.

The landlord must tell the city who bought the building within 5 days. The city can still make the new owner fix the problems, and the old landlord has to give the city personal details about the buyer.
