§ 1542 Facility Ownership Transfer Actions

Key Takeaways

  • •If the boss (director) sues a care home, the lawsuit doesn’t stop just because the care home gets a new owner.
  • •The lawsuit only stops if the boss (director) writes a note saying it’s okay.
  • •The new owner can’t just say, 'It’s not my problem now.'

Example

A nursing home gets sued because they didn’t take care of patients well. While the lawsuit is happening, the nursing home gets sold to a new owner.

The lawsuit doesn’t go away just because there’s a new owner. The new owner still has to deal with it unless the boss (director) writes a note saying it’s okay to stop.
