§ 131220 County Hospital Regulation Waivers

Key Takeaways

  • •Small counties (with 200,000 or fewer people) can ask to skip some hospital rules if they follow federal laws.
  • •The county leaders must ask for the rule change and hold a public meeting first.
  • •The change can only happen if it won’t hurt people’s health or safety.
  • •This doesn’t replace other ways to change hospital rules—it’s just another option.

Example

A small county wants to keep its only hospital open but can’t afford all the usual rules.

The county leaders can ask the state to skip some rules, like having a certain number of nurses, if they prove it won’t make patients less safe. They must hold a public meeting to let people talk about it first.

Notwithstanding any other provision of law, but to the extent consistent with applicable federal law or regulation, the director may, after a request by a board of supervisors of an affected county and after a public hearing held in accordance with Section 11346 of the Government Code, waive regulations pertaining to the provision of hospital services in a hospital operated by a county or under contract to a county for a county with a population of 200,000 or less on January 1, 1980, if the director makes a finding that the waiver would not affect adversely the health and safety of persons in the county. The authority contained in this section shall be in addition to, and shall not supersede or limit, any other provision of law authorizing the waiver by the department of requirements contained in regulations adopted by the department relating to health facilities. (Added by Stats. 2006, Ch. 241, Sec. 34. Effective January 1, 2007. Operative July 1, 2007, by Sec. 37 of Ch. 241.)
