§ 1283 Minor Custody Release Rules

Key Takeaways

  • •Hospitals or clinics can't let a kid under 16 go with someone unless a parent, legal guardian, or a relative who takes care of them says it's okay in writing.
  • •If the kid is given to someone who isn't a parent, relative, or legal guardian, the hospital must tell the State Health Department within 48 hours.
  • •The hospital doesn't need to report if the kid is moved to another hospital or if they're given to a social worker, probation officer, or police.

Example

A 14-year-old kid is in the hospital after breaking their arm. Their aunt, who isn't their legal guardian, comes to pick them up.

The hospital can only let the kid go with the aunt if the kid's parent or legal guardian wrote a note saying it's okay. If not, the hospital has to call the State Health Department within 48 hours to tell them who took the kid.

(b)  A health facility shall report to the State Department of Health Services, on forms supplied by the department, the name and address of any person and, in the case of a person acting as an agent for an organization, the name and address of the organization, into whose physical custody a minor under the age of 16 is surrendered, other than a parent, relative by blood or marriage, or person having legal custody. This report shall be transmitted to the department within 48 hours of the surrendering of custody. No report to the department is required if a minor under the age of 16 is transferred to another health facility for further care or if this minor comes within Section 300, 601, or 602 of the Welfare and Institutions Code and is released to an agent of a public welfare, probation, or law enforcement agency.
