§ 128175 State Agency Project Hearings

Key Takeaways

  • •Before approving special projects, the department must ask experts and licensing boards for advice.
  • •If a state agency is involved, there must be a fair hearing run by someone not connected to the project.
  • •People who care about the project get a notice 30 days before the hearing with all the details.
  • •After the hearing, the department has 60 days to make a recommendation, and the director decides yes or no after 30 more days.

Example

A state agency wants to start a new program to test a new way of training doctors.

The department must first ask doctors and medical boards what they think. Then, they hold a hearing with someone unbiased in charge. They send notices to people who might care, like hospitals or patients. After the hearing, they write a report and wait for the director to say yes or no.
