§ 12726 Seized Fireworks Disposal Rules

Key Takeaways

  • •If dangerous fireworks are taken away by the police, the State Fire Marshal decides what to do with them.
  • •Fireworks that are considered dangerous waste must be handled like trash that can hurt people or the environment.
  • •The fireworks can't be sold again to regular people. They can only be used for training, testing, or investigations by police or fire departments.
  • •If a city or town collects money from fines for illegal fireworks, most of that money goes to the state to help pay for fireworks safety.

Example

Someone is caught with a box of powerful fireworks that are illegal in California.

The police take the fireworks away. The State Fire Marshal will decide what to do with them. They might use them to train firefighters, test them to make sure they're safe, or throw them away safely if they're too dangerous. The fireworks can't be sold to anyone else.
