§ 11576 Citizen Complaint Dismissal Rules

Key Takeaways

  • •If a regular person starts a legal complaint, they can't just drop it whenever they want.
  • •To stop the complaint, they must write a sworn statement with their lawyer explaining why they want to stop.
  • •A judge must then approve the request to drop the case.

Example

You file a complaint against your neighbor for damaging your fence.

If you later decide you don’t want to pursue the case, you can’t just walk away. You and your lawyer must write a sworn statement explaining why you want to drop it, and a judge has to agree to let you stop the case.
