§ 110505 Food Labeling Standards

Key Takeaways

  • •Food labels and quality rules in this state follow the same rules as the federal government.
  • •The state can make its own rules for food labels and quality if it helps protect shoppers.
  • •These rules don’t apply to wine.

Example

You buy a jar of peanut butter at the store.

The label must match the rules set by the government, like saying what’s inside and how much. If the state thinks the label is confusing or unfair, they can make their own rules to help you know what you’re buying.

The department may, by regulation, establish definitions and standards of identity, quality, and fill of container for any food whether or not the definitions and standards are in accordance with the federal regulations, when in its judgment such action will promote honesty and fair dealing in the interest of consumers. This section shall not apply to wine. (Added by Stats. 1995, Ch. 415, Sec. 6. Effective January 1, 1996.)
