§ 108220 Household Hazardous Substance Bans

This law lets the department quickly call a household chemical a "banned hazardous substance" if it believes the product is an immediate danger to public health, even before full rule-making is finished.

Key Takeaways

  • •The department can issue a temporary ban when there is an imminent health hazard.
  • •The ban remains effective until formal regulations are completed.
  • •The process follows the rules set out in Section 108335.

Example

A company makes a cleaning spray that is found to be toxic and could harm children when used at home.

The department can publish a notice saying the spray is banned for household use right away, and the ban stays in place until they finish creating formal regulations about such products.
