§ 105443 Biomonitoring Results And Follow-Up

This law says that anyone who takes part in the state’s biomonitoring program must be tested for certain chemicals, get clear information about the program, can ask for their full results, and will be helped if the results show a serious health risk.

Key Takeaways

  • •All participants are tested for designated chemicals and can request their full results.
  • •If a test shows a serious health risk, trained staff must talk with the person and suggest follow‑up actions.
  • •The program must choose participants so the group reflects the state’s age, income, race, and ethnicity, and all outreach materials should be culturally appropriate and translated when needed.

Example

A resident volunteers for a blood‑test program that checks for lead. After the lab finds a high lead level, a trained staff member meets with the resident, explains what the number means, and suggests a doctor visit and ways to lower exposure.

The program tests the person, gives them the results, and when the result shows a known health danger, staff talk to the person and recommend next steps, just as the law requires.

§ 105443 Biomonitoring Results And Follow-Up

(a) All participants shall be evaluated for the presence of designated chemicals as a component of the biomonitoring process. Participants shall be provided with information and fact sheets about the program’s activities and its findings. Individual participants may request and shall receive their complete results. Any results provided to participants shall be subject to the Institutional Review Board protocols and guidelines. When either physiological or chemical data obtained from a participant indicate a significant known health risk, program staff experienced in communicating biomonitoring results shall consult with the individual and recommend followup steps, as appropriate. Program administrators shall receive training in administering the program in an ethical, culturally sensitive, participatory, and community-based manner. (b) Individuals selected to participate in the biomonitoring program shall reflect the age, economic, racial, and ethnic composition of the state. Other selection criteria may be applied, as appropriate, for studies of specific populations. (c) Informational materials and outreach activities directed to program participants and communities shall, to the extent possible, be culturally appropriate and translated as needed. Educational materials shall be adapted to the biological specimens being used. (Added by Stats. 2006, Ch. 599, Sec. 2. Effective January 1, 2007.)
