§ 102805 Embalmer Signature Authorization

This rule lets an embalmer let someone else sign the required certificate after the embalming, but only if there is a written special power of attorney that is kept for a year.

Key Takeaways

  • •An embalmer can let another person sign the certificate after embalming.
  • •The permission must be a written special power of attorney.
  • •The written power of attorney has to be kept for at least one year.

Example

An embalmer finishes preparing a body and gives a written power of attorney to the funeral home manager so the manager can sign the embalming certificate.

Because the embalmer gave a written special power of attorney, the manager is allowed to sign the certificate, and the funeral home must keep that power of attorney on file for one year.
