§ 102750 Acknowledgment Of Parentage Process

This law lets a mother and the other biological or intended parent officially claim a child as theirs by signing a sworn statement, as long as the birth record doesn’t already say something different.

Key Takeaways

  • •Both the mother and the other parent must sign an affidavit to claim the child.
  • •The birth certificate must not already have conflicting parent information.
  • •The paperwork is filed with the State Registrar using a specific form.

Example

A baby is born through a surrogate, and the intended dad wants his name on the birth record.

The mom and the intended dad sign affidavits saying they are the parents, then send those papers on a special form to the State Registrar. Because the original birth certificate doesn’t list a dad, the registrar can add his name.
