§ 101878 Retroactive Corporate Records Application

This law says that the new rules apply to all old records of any company that the law covers, even if those records were made before the law existed.

Key Takeaways

  • •The law works retroactively – it reaches back to cover old records.
  • •It applies to any corporation that the chapter is meant for.
  • •The retroactive effect starts on the law’s effective date (Jan. 1, 1998).

Example

A company kept its financial reports from 1995 on file. The new law took effect on Jan. 1, 1998.

Even though the reports were written before 1998, the company must now follow the new rules for those old reports because the law works retroactively.
