§ 100930 Religious Healing Exemption

This law says that people who heal others by prayer, as part of a recognized religion, cannot be forced to share non‑contagious health details or be made to take compulsory schooling, medical exams, or treatment.

Key Takeaways

  • •Prayer‑based healers are protected from being forced to disclose non‑contagious disease information.
  • •No one can require compulsory education, medical exams, or treatment for those healers or the people they treat.
  • •The protection applies to any well‑recognized church, sect, denomination, or organization and to certain professionals listed in the Business and Professions Code.

Example

A pastor prays for a member who has a broken arm. The state cannot demand the pastor tell the doctor exactly what the pastor sees in the prayer session, nor can the state force the member to go to a forced medical exam or treatment because of the prayer.

Because the pastor is using prayer as a healing method for a recognized faith, the law protects them from being compelled to give non‑infectious health info or to require any compulsory medical actions.
