§ 100290 Local Health Regulation Review

• •All new health regulations (except emergency ones) must be sent to the California Conference of Local Health Officers for comment before they are adopted.
• •The department can still adopt a rule that the conference disagrees with, but it must publicly explain why.
• •The rule applies to any health matters that the state has given to local health departments.

The state health department wants to create a new rule about how often restaurants must be inspected for food safety.

Before the rule can be adopted, the department must give the draft to the California Conference of Local Health Officers so they can comment. If the department decides to go ahead with the rule even though the conference says it’s not needed, the department must publish a clear explanation of why it’s doing that.
