§ 6060 District Commissioner Compensation Rules

This law says commissioners work for free until the district makes more than $20,000 a year, then they can be paid up to $600 a month each, plus they can be reimbursed for real expenses they incur while doing their job.

Key Takeaways

  • •Commissioners are unpaid until the district’s yearly income is over $20,000.
  • •Once the income is over $20,000, the board can set a salary, but it can’t be more than $600 a month per commissioner.
  • •Commissioners can also be paid back for any real expenses they actually spend while doing their duties.

Example

A small town's water district earns $18,000 in a year. The commissioners keep working without pay. Next year the district earns $25,000, so the board can decide to pay each commissioner up to $600 a month.

Because the district's income went over $20,000, the law now allows the board to set a salary (but not more than $600 per month) and still let commissioners get back any money they spent on district business.

How to Calculate

Salary_per_commissioner = { 0, if Gross_Income ≤ 20,000; ≤ $600 per month, if Gross_Income > 20,000 }

  1. Find the district's yearly gross income (do not count any taxes the district collects).
  2. Compare that number to $20,000.
  3. Step 3a: If the income is $20,000 or less, the commissioners get no salary.
  4. Step 3b: If the income is more than $20,000, the board may set a salary, but it cannot be higher than $600 for each month.

The district earned $45,000 this year.

Result: Since $45,000 > $20,000, each commissioner can be paid up to $600 per month.

In addition to any salary received pursuant to this section, the commissioners shall be allowed any actual and necessary expenses incurred in the performance of their duties.
