§ 292 Collision Loss Allocation

This law tells how to split the costs of a crash depending on who caused it.

Key Takeaways

  • •If only one side is at fault, that side pays its own loss and also pays the other side for any loss the other side suffered.
  • •If neither side is at fault, each side pays its own loss.
  • •If both sides are at fault, the loss is split equally unless one side is much more at fault, then the split is adjusted fairly.
  • •If it’s impossible to tell who is at fault, the loss is split equally.

Example

Two cars bump into each other at an intersection. One driver ran a red light and the other was driving straight.

Because the driver who ran the red light is the only one at fault, that driver pays for his own damage and also pays the other driver for the damage the other driver suffered.

§ 292 Collision Loss Allocation

Losses caused by collision are to be borne as follows: (a) If either party was exclusively in fault he shall bear his own loss, and he shall compensate the other for any loss he has sustained. (b) If neither was in fault, the loss shall be borne by him upon whom it falls. (c) If both were in fault, the loss shall be equally divided, unless it appears that there was a great disparity in fault, in which case the loss shall be equitably apportioned. (d) If it can not be ascertained where the fault lies, the loss shall be equally divided. (Enacted by Stats. 1937, Ch. 368.)
