§ 1183 Pilot License Nonrenewal Review

This law says that if a pilot’s license is not renewed, suspended, or taken away, the pilot gets a hearing like any other pilot case, and the final board decision can be checked by a court.

Key Takeaways

  • •A pilot gets a trial and hearing when the license is not renewed.
  • •Any board decision to suspend or cancel a pilot’s license can be reviewed by a court.
  • •The court must look at the evidence on its own and make an independent judgment.

Example

A pilot gets a notice that his license will not be renewed because of safety concerns.

The pilot can ask for a trial and hearing to argue his case, and if the board still decides to cancel the license, he can ask a court to look at the evidence and decide if the board’s choice was fair.
