§ 9144 Judicial Impact Analysis Requirements

Key Takeaways

  • •The Legislative Analyst has to study how some new laws might affect the courts, like how much work and money they might need.
  • •They pick the laws that seem like they’ll have the biggest effect on the courts to study first.
  • •The study results must be given to the lawmakers before they vote on the law.
  • •This whole thing was tried for 9 months to see if it worked well.

Example

Imagine a new law says more people can sue their neighbors over loud parties.

The Legislative Analyst would study how many more cases the courts might get because of this law and how much extra money and judges would be needed. They’d tell the lawmakers this info before the vote.

The Legislative Analyst shall select for analysis, as his or her staff resources permit with no additional staff, those measures with the greatest apparent potential impact on court manpower and costs. Other measures may be analyzed as staff resources permit. The analysis of a measure shall be given to the respective committee members prior to the date on which the measure is to be heard by the committee. The analyses required by this section shall be performed on a nine-month trial basis. Thereafter, the cost and effectiveness of this type of analysis for the specified policy committees shall be evaluated by the three respective committees. (Amended by Stats. 1996, Ch. 155, Sec. 1.
