§ 906 Claim Payment Interest Rules

Key Takeaways

  • •The 'amount allowed on the claim' is the money the government agrees to pay for a claim.
  • •Usually, the government doesn't have to pay extra money (interest) on a claim if it needs the Legislature's approval to pay it.
  • •If the Legislature approves the payment, the government starts owing extra money (interest) 180 days after the approval.

Example

You file a claim against the government for $1,000 because your car got damaged by a pothole.

The government agrees to pay you $800, but they need the Legislature's approval to pay you. The Legislature approves the payment. The government has to start paying extra money (interest) on the $800 if they don't pay you within 180 days after the approval.
