§ 75050 Retirement Account Division Orders

Key Takeaways

  • •When a married couple splits up, the court decides the date they separated.
  • •If the court says to split the retirement money, the money earned during the marriage gets divided into two separate accounts—one for each person.
  • •The person who isn’t the member (nonmember) can get retirement money, take out their contributions, or choose who gets their money if they die.
  • •The nonmember can’t get disability retirement money.

Example

A married couple gets divorced. One spouse is a teacher and has a retirement account. The court says to split the retirement money earned during the marriage.

The retirement money earned while they were married gets split into two accounts—one for the teacher and one for the ex-spouse. The ex-spouse can later get retirement payments or take out their share of the money.
