§ 75006 Retired Judge Unpaid Benefits

Key Takeaways

  • •If a retired judge or their family member dies and they were supposed to get paid but didn't, the money goes to their family first.
  • •If there's no family, the money goes to whoever the judge or family member chose to get it.
  • •If there's no one chosen, the money goes to the dead person's estate or trust.
  • •If there's no estate or trust, the money goes to the next closest family member.

Example

A retired judge passes away and had some unpaid money from their retirement.

First, the money would go to their spouse or kids. If they don't have any, it goes to whoever they picked to get the money. If they didn't pick anyone, it goes to their estate or trust. If there's none of that, it goes to their closest family, like siblings or parents.
