§ 68752 Subpoena Enforcement Orders

Key Takeaways

  • •If you ignore a subpoena (a court order to show up or bring documents), the court can make you obey it.
  • •The court will ask you why you didn’t follow the subpoena. If your reason isn’t good, you’ll have to do what it says.
  • •If you still refuse after the court orders you to obey, you can be punished for disrespecting the court (like a fine or jail time).

Example

You get a subpoena to show up in court and bring some papers, but you ignore it because you don’t feel like going.

The court can order you to come and explain why you didn’t show up. If they think the subpoena was valid, they’ll make you go to court and bring the papers. If you still refuse, you could be in big trouble for not listening to the court.

The court shall order the person to appear before it at a specified time and place and then and there show cause why the person has not attended or testified or produced the writings or things as required. A copy of the order shall be served upon the person. If it appears to the court that the subpoena was regularly issued, the court shall order the person to appear before the commission or the masters at the time and place fixed in the order and testify or produce the required writings or things. Upon failure to obey the order, the person shall be dealt with as for contempt of court. (Amended by Stats. 2021, Ch. 79, Sec. 13. (AB 143) Effective July 16, 2021.)
