§ 66959 Fair Land Purchase Compensation

Key Takeaways

  • •If a government rule makes land worth less (like to protect water or nature), the agency buying the land can pay a fair price.
  • •The agency can look at how much the owner paid for the land before, any extra fees they paid, and other things to make sure the price is fair.
  • •This rule helps landowners get a reasonable deal if the land's value dropped because of new rules.

Example

A farmer owns land near a river. The government makes a new rule to protect the river, so the farmer can't use part of the land anymore. Now the land is worth less.

If the government wants to buy the farmer's land, they can't just pay the new lower price. They have to think about what the farmer paid for the land before, any extra costs the farmer had, and make sure the price is fair.

§ 66959 Fair Land Purchase Compensation

If the value of any land to be purchased by the agency has been substantially reduced by any statute, ordinance, rule, regulation, or other order adopted after January 1, 1980, by state or local government for the purpose of protecting water quality or other resources in the region, the agency may purchase the land for a price it determines would assure fairness to the landowner. In determining the price to be paid for the land, the agency may consider the price which the owner originally paid for the land, any special assessments paid by the landowner, and any other factors the agency determines should be considered to ensure that the landowner receives a fair and reasonable price for the land. (Added by Stats. 1982, Ch. 305, Sec. 1. Approved in Proposition 4 at the November 2, 1982, election. Operative January 1, 1983, by Sec. 2 of Ch. 305.)
